House Hunting in Tyler, Texas

We drove to Tyler on Monday morning and looked around the area to become familiar with what was available. We drove around Lake Palestine and Lake Tyler and tried to find some of the houses we would tour tomorrow. We didn't find any but the streets are all county roads and without a map it is all but impossible to find anything. We were able to see parts of each lake and a lot of the surrounding area. We went to the China Cafe for dinner and had a great dinner.

On Tuesday morning we met Sherrie Roberts, our real estate agent, and began to tour homes that we had previously shown interest. We saw a few homes that we were interested in but one that seemed to be perfect from both of our viewpoints. After a nice lunch we continued the tour and then returned to Sherrie's office to discuss what we wanted to do. After some additional thought and discussion we decided to make an offer on the home we really liked. The home had a wonderful yard on the lake side with large trees, grass, a large deck area with a view of the lake, and a great boat house with two slips and an electric winch for each slip. The lake side of the house was basically one big room with windows that had a terrific view of the lake. The street side of the house had the bedrooms, bathrooms, and kitchen. The master bedroom would need a little work in the bathroom-closet area but the rest was way beyond our expectation.

Outside there was a two car garage that had been converted to a large workshop but could be converted back to a garage, a storage building about 12X12, and a small greenhouse. There was also enough room for two motorhome pads on the street side without interferring with the driveway. Well we were pretty excited and after we signed the papers we drove back to Arlington to meet Mike and Patty and wait to find out if our offer was accepted. We didn't get any calls that night and it wasn't until late in the afternoon on Wednesday that we got the call and found out that another couple had also made an offer and their's was accepted by the seller. We were pretty dissapointed because the money difference between the offers was pretty small.

We later found out later that the agent for the seller was also the agent for the buyer and that the buyer knew about our offer before they wrote their offer. In addition we were not informed that there was another offer on the table. We are exploring legal remedies but it seems that there was no violation of the law just a trashing of the Realtor Code of Ethics. Our agent is waiting for a legal opinion from the board of realtors attorney and that should come today. We plan to file a complaint with the Board of Realtors regarding the ethics the agent for seller used but that probably won't do much. This agent will receive a double commission because she is the agent for both the buyer and seller and we feel this had a big part to play in how this deal was handled.

We drove back to Tyler on Thursday with Mike and Patty and looked at two homes that were possibles but the second look didn't help and it was apparent that both needed too much work. Our plan now is to wait and see if other properties come on the market and hopefully something nice will come along. In the meantime we will continue out trip and if necessary come back this way later. Mike and I will play golf today so I must get moving. More later so be safe.
